Prestino.pl store terms and conditions
§ 1. General provisions and seller details
- These terms govern use of Prestino.pl, placing orders, entering into and performing contracts for digital content, using purchased modules and handling complaints.
- The shop operates at https://www.prestino.pl/ and is operated by SmartBest sp. z o.o., ul. Dworcowa 28/22, 14-400 Pasłęk, Poland; KRS 0001008490, tax identification number (NIP) 5783158641, REGON 523933304, share capital PLN 10,000.00, referred to below as the Seller.
- Contact the Seller by email at support@prestino.pl, including for complaints, or by post at ul. Spółdzielcza 12, 14-400 Pasłęk, Poland, or at the registered-office address above.
- These terms are available free of charge before the contract is concluded in a form that can be obtained, reproduced and stored. The Customer may save or print them.
- Using the shop requires an internet-connected device, an up-to-date browser supporting JavaScript and cookies, and an active email address. Downloading and installing a Module may also require ZIP archive software and administrative and file access to the PrestaShop shop.
- Use of the shop must not involve unlawful content, infringe third-party rights or disrupt the shop.
§ 2. Definitions
- Customer: a natural person, legal person or organisational entity placing an Order or using the shop’s services.
- Consumer: a natural person entering into a legal transaction with a trader which is not directly related to that person’s business or professional activity.
- Entrepreneur with consumer rights: a natural person entering into a contract directly related to their business where the contract shows it is not professional in nature for that person, in particular in light of their business activity disclosed in the Polish CEIDG register.
- Module: software, an extension, integration, theme, patch or other digital content described in the shop’s offer, particularly for use with PrestaShop. Digital Content: data produced and supplied digitally, including Modules, documentation and update files.
- Licence: the right to use a Module under § 7 and its product description. Account: the Customer’s individual panel, where available. Order: the Customer’s declaration directly leading to a contract with the Seller. Business Days: Monday to Friday, excluding public holidays in Poland.
§ 3. Electronic services and Accounts
- The Seller enables browsing offers, placing Orders, creating and operating Accounts where available, accessing purchased files, licences and updates within the scope of the offer, and using contact and complaint forms where available.
- An Account contract is concluded for an indefinite period when registration is confirmed. The Customer may request deletion at any time without giving a reason by contacting support@prestino.pl. Deletion does not affect acquired rights or release either party from earlier contracts.
- The Customer should protect login details and not share the Account with unauthorised persons. Suspected Account compromise should be reported to the Seller without delay. Complaints about electronic services may be made under § 10.
§ 4. Module information
- The Module description specifies its main features, price, intended use, technical requirements, compatible PrestaShop versions and, where relevant, requirements concerning PHP, themes, other modules, external services or accounts.
- Before purchase, the Customer should check compatibility with their environment. This does not limit the Seller’s liability for conformity of Digital Content with the contract.
- PrestaShop and other third-party trademarks indicate compatibility or intended use only. The Seller is not affiliated with those parties unless the offer expressly states otherwise.
- Any requirement for a paid third-party service, API key, account or additional software is stated in the Module description. Third-party fees are not included unless the offer expressly states otherwise.
§ 5. Orders and conclusion of contracts
- The Customer selects a Module, adds it to the cart, supplies the required information, chooses a payment method and confirms the Order using a button that clearly indicates an obligation to pay.
- Before ordering, the Customer can review and correct information and read these terms, the total price, functionality, compatibility, interoperability and other material Module information.
- An Order constitutes an offer to conclude a contract. The contract is concluded when the Seller sends confirmation that the Order has been accepted for fulfilment, unless the checkout message expressly indicates an earlier point.
- Confirmation of the contract, these terms and legally required information are supplied on a durable medium, particularly by email. An invoice is issued using the Customer’s information, for whose accuracy the Customer is responsible.
- The Seller may refuse fulfilment only for a valid reason, including unsuccessful payment, manifestly incorrect information, an unlawful Order or an abuse indication from the shop’s security systems. The Seller informs the Customer without delay and refunds any payment received.
§ 6. Prices, payment and delivery
- Prices are stated in the currency displayed in the shop and include taxes required by law. The total price and any additional charges are disclosed before the Order is placed.
- Available payment methods and any payment deadlines are displayed in the cart. Payments may be handled by the external operators identified at checkout.
- The Module is delivered by making a download available in the Account, emailing a download link or another method described in the offer. Unless stated otherwise, delivery takes place without delay after payment is confirmed by the operator.
- The Seller supplies the version current at purchase and updates necessary to maintain conformity for the period required by law. Additional feature updates and support are provided for the period in the offer, by default 365 days from purchase.
- If delivery does not take place, the Customer should call on the Seller to deliver. If the Seller fails to deliver without delay or within an additional period expressly agreed by the parties, the Consumer may withdraw. Such a request is unnecessary where the law provides otherwise, including if the Seller refuses delivery or an essential deadline was made known to the Seller.
§ 7. Licence
- Upon delivery and full payment, the Seller grants a non-exclusive, non-transferable licence to use the Module under these terms and its offer.
- Unless the offer states otherwise, one Licence permits installation and use in one production PrestaShop shop on one domain and a related testing or development environment not publicly accessible to end customers.
- A full Licence is granted worldwide for an indefinite period. A trial Licence lasts for the period specified in the offer, by default 30 days.
- Within the Licence, the Customer may install, run, configure, back up and modify the Module for their own needs unless the offer states otherwise. Modification may affect support only to the extent the problem results from that modification.
- Without prior written consent, the Customer may not sell, sublicense, rent, lease or otherwise provide the Module as a standalone product to third parties; publish or distribute its source code or files; remove authorship or licence notices; use one Licence in more production shops than permitted; or use the Module unlawfully or in breach of third-party rights.
- A shop developer may transfer the Licence to their end customer only with the Seller’s prior consent or through an available licence-owner reassignment function. After transfer, the developer loses the independent right to use the same Licence.
- Expiry of updates or support does not remove the right to use the downloaded Module for the Licence term, unless a subscription offer expressly states otherwise. This section does not limit mandatory rights of a lawful software user.
§ 8. Installation, updates and support
- Installation, configuration, integration and custom adaptation are included only where expressly stated in the offer or agreed separately.
- Before installation or updates, the Customer should back up files and the database and, where possible, test changes in a testing environment.
- Support includes installation and configuration explanations and diagnosing and correcting Module errors. It is provided by email or the Seller’s ticket system on Business Days without undue delay. No particular response time is guaranteed unless a service level is separately agreed.
- Unless the offer states otherwise, support excludes shop administration, custom changes, repairs to other modules, themes or third-party software, and rectifying effects of changes made by the Customer or third parties.
- The Customer should install notified updates necessary for conformity and security. The Seller is not liable for non-conformity resulting solely from failure to install such an update within a reasonable time where the Customer was informed of the update and consequences and the problem was not caused by faulty Seller instructions.
§ 9. Conformity of Digital Content
- The Seller is liable to Consumers and Entrepreneurs with consumer rights for conformity under the Polish Consumer Rights Act. Nothing in this section excludes or limits mandatory rights.
- Conformity includes the description, type, quantity, quality, functionality, compatibility, interoperability, availability of updates, suitability for the agreed purpose and other features corresponding to the contract, offer, demo or announcement, taking account of the nature of the Digital Content.
- For non-conforming content, the Consumer may request that it be brought into conformity. The Seller may refuse if impossible or disproportionately costly.
- The Seller brings the Module into conformity at its own cost within a reasonable time after notification and without excessive inconvenience, taking account of the Module’s nature and intended use.
- The Consumer may request a price reduction or withdraw in cases specified by law, including where conformity is impossible or disproportionately costly, the Seller has failed to restore conformity, the lack continues, it is sufficiently serious to justify immediate reduction or withdrawal, or the Seller has stated that it will not restore conformity within a reasonable time or without excessive inconvenience.
- For paid Modules, withdrawal is unavailable for insignificant non-conformity. Non-conformity is presumed significant.
- Following withdrawal, the Consumer must stop using and sharing the Module. The Seller refunds the price within the time and in the manner required by law.
- The Seller is not responsible for a Customer environment failing to meet requirements clearly disclosed before contracting, subject to correct integration where performed by or under the responsibility of the Seller.
§ 10. Complaints
- Complaints may be emailed to support@prestino.pl or sent by post to the Seller.
- To assist handling, provide the Customer’s name or company, Order number, Module name and version, licensed domain, PrestaShop and PHP versions, problem description, requested resolution and, where possible, safe diagnostic information. Missing information does not prevent consideration of a Consumer complaint where its subject can be identified.
- The Seller may request information needed to reproduce an error. Customers should not send passwords or their customers’ personal data unless necessary and the parties have agreed a secure transfer method and appropriate processing basis.
- The Seller responds to Consumer complaints within 14 days of receipt, on paper or another durable medium. Failure to respond means acceptance where provided by law.
- Rights of Customers who are neither Consumers nor Entrepreneurs with consumer rights follow from the contract and the Polish Civil Code, subject to § 13.
§ 11. Right of withdrawal
- Consumers and Entrepreneurs with consumer rights may generally withdraw from a distance contract within 14 days of conclusion without giving a reason.
- Send an unambiguous withdrawal statement to support@prestino.pl or the Seller’s postal address. The model form in Appendix 1 is optional. Sending the statement before the deadline is sufficient.
- Following effective withdrawal, the Seller refunds payments without delay and within 14 days after receiving the statement, using the original payment method unless the Customer expressly agrees to another cost-free method.
- The right to withdraw from a contract for a Module not supplied on a tangible medium is lost only if all of the following apply: performance began with the Consumer’s express prior consent; before performance, the Consumer was informed that they would lose the right after performance and acknowledged this; and the Seller supplied confirmation of the contract on a durable medium.
- Consent to early supply must be obtained separately from acceptance of these terms. Example: “I consent to supply of the digital content before the end of the 14-day withdrawal period. I acknowledge that once performance begins I will lose my right to withdraw.”
- If the conditions for loss of the right are not met, downloading a file alone does not remove the Consumer’s statutory withdrawal right.
§ 12. Out-of-court dispute resolution
- Consumers may use out-of-court complaint and redress procedures, including the competent regional Trade Inspection authority, permanent arbitration court at the Trade Inspection, district or municipal consumer ombudsman, or consumer organisations.
- Information is available at https://polubowne.uokik.gov.pl/. Participation is voluntary and requires both parties’ consent unless specific legislation provides otherwise.
§ 13. Business Customers
- This section applies only to Customers who are neither Consumers nor Entrepreneurs with consumer rights.
- Statutory warranty liability under the Polish Civil Code is excluded to the extent permitted by law.
- Liability for non-performance or improper performance is limited to actual loss and the net amount paid for the Module during the 12 months preceding the event. The Seller is not liable for lost profits, lost data or indirect loss, except for intentional damage or where mandatory law prohibits the limitation.
- Business Customers must inspect the Module promptly after delivery and report irregularities without undue delay.
- Polish law applies and disputes are decided by the court competent for the Seller’s registered office, unless mandatory law provides otherwise.
§ 14. Personal data
- Processing of personal data and cookies is described in the Legal information and privacy policy page linked in the shop footer.
- Where support requires access to personal data processed by the Customer, the parties determine their roles and, if required, conclude a data processing agreement before access is granted.
§ 15. Changes to these terms
- The Seller may amend these terms for important reasons, including changes to law, payment or delivery methods, shop functionality, security, Seller details or service scope.
- A one-off contract is governed by the version accepted when the Order was placed.
- For ongoing services, including Accounts, notice is given on a durable medium at least 14 days before a change takes effect. The Customer may terminate without additional cost before that date. A change may take effect earlier where required by law or urgent security needs, preserving statutory Customer rights.
- Changes do not affect acquired rights or Consumer entitlements under earlier contracts.
§ 16. Final provisions
- Contracts through the shop are governed by Polish law. This choice does not deprive a Consumer of non-excludable protection under the law of their country of habitual residence.
- These terms do not limit mandatory rights of Consumers or Entrepreneurs with consumer rights. Mandatory provisions prevail in the event of conflict.
- If a provision is invalid or ineffective, the remaining provisions remain in force. These terms apply from 12 August 2026.
